Please read these Terms carefully. They contain important disclaimers about injury risk, a release of liability, a mandatory arbitration clause (Section 13), and a class-action waiver. By using Stretch Quest you agree to be bound by these Terms.
These Terms of Service ("Terms") are a binding agreement between you and Zoss Family Holdings, LLC("Company", "we", "us", "our"), which operates the Stretch Quest application and website at playstretchquest.com ("the Service"). By creating an account, completing the in-app consent form, or otherwise using the Service, you accept these Terms. If you do not agree, do not use the Service.
If you are creating an account on behalf of a minor, you confirm that you are the child's parent or legal guardian, that you are at least 18 years old, and that you consent to these Terms on the child's behalf and on your own behalf.
Stretch Quest is a gamified stretching application that provides general physical activity guidance through an interactive, game-based experience. The Service offers a free tier and paid subscription tiers with additional features such as cloud sync and family profiles.
Stretch Quest is not a medical device, medical product, or healthcare service. It does not provide medical advice, diagnosis, or treatment. The exercises, videos, descriptions, and content provided are for general informational and educational purposes only and are not a substitute for professional medical advice from a licensed physician, physical therapist, or other qualified healthcare provider.
Always consult with a qualified healthcare provider before beginning any exercise program, particularly if you or your child have: Sever's disease, Osgood-Schlatter disease, any musculoskeletal injury, heart or circulatory condition, recent surgery, pregnancy, dizziness, balance issues, seizure disorders, or any other medical condition.
You should immediately stop any exercise that causes pain, dizziness, discomfort, or shortness of breath, and consult a healthcare provider. If you experience a medical emergency, call your local emergency services.
Physical activity, stretching, and exercise carry inherent risks, including but not limited to muscle strain, joint injury, falls, bruising, and in rare cases, more serious injuries. By using the Service, you voluntarily and knowingly assume all risks of injury or loss arising from or related to your (or your child's) use of the Service, including performing any exercise shown in the app.
To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and hold harmlessZoss Family Holdings, LLC, its officers, members, employees, affiliates, agents, contractors, and licensors (collectively, the "Released Parties") from any and all claims, actions, demands, liabilities, losses, damages, costs, or expenses (including reasonable attorneys' fees) arising from or related to: (a) any injury or property damage suffered by you or your child during or after use of the Service; (b) your reliance on any content in the Service; and (c) your (or your child's) failure to consult a healthcare provider before using the Service.
This release applies to claims based on negligence, strict liability, or any other theory of liability, to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in such jurisdictions, our liability is limited to the fullest extent permitted by law.
The free tier provides access to all 40 exercises, all character themes (Princess, Warrior, Sage), full gamification, and offline functionality. The free tier requires no account and stores all data locally on your device. We may modify free tier features with reasonable notice.
See our full Refund Policy. In summary: the free trial is a risk-free way to evaluate the Service. If you are charged and believe the charge was made in error, contact us within 30 days at support@playstretchquest.com. Refund decisions are made at our reasonable discretion.
You may delete your account at any time by contacting support. We may suspend or terminate accounts that violate these Terms, infringe intellectual property rights, engage in fraud, or are used in ways we reasonably believe are abusive, illegal, or harmful. Upon termination, your account data will be handled in accordance with our Privacy Policy.
All content, design, code, graphics, characters, text, and assets in the Service are owned by the Company or licensed to it and are protected by copyright, trademark, and other intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service. User-generated content (character names, game progress) remains yours.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, accuracy, or fitness for any medical or health purpose. We do not warrant that exercise content is appropriate for any specific medical condition or individual.
To the fullest extent permitted by law, in no event shall the Released Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or any damages arising from personal injury related to use of the Service.
Our total aggregate liability to you for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
Please read this section carefully. It affects your legal rights.
a. Informal resolution. Before filing a claim, you agree to contact us at support@playstretchquest.com and give us 60 days to resolve the dispute in good faith.
b. Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in the county where you reside or, if you agree, by telephone or video conference. Judgment on the arbitrator's award may be entered in any court with jurisdiction.
c. Class-action waiver. You agree that disputes will be brought only in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative action.
d. Exceptions. Notwithstanding the above, either party may bring an individual action in small claims court, and either party may seek injunctive or equitable relief in court to protect intellectual property.
e. Opt-out. You may opt out of this arbitration agreement by sending written notice to support@playstretchquest.com within 30 days of first accepting these Terms. Your opt-out will not affect any other provision of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to the arbitration clause above, any claim not subject to arbitration shall be brought in the state or federal courts located in Los Angeles County, California, and you consent to the exclusive jurisdiction and venue of such courts.
You agree to defend, indemnify, and hold harmless the Released Parties from any third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any claim that use of the Service caused injury or harm to you, your child, or any person in your household.
We may update these Terms from time to time. Material changes will be communicated via email (for account holders) or an in-app notice. Continued use after changes take effect constitutes acceptance. If you do not agree with the updated Terms, your sole remedy is to stop using the Service.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.
